Well, since JM altered his blog, I'm going with Bates as well as Everett didn't get nailed till season 2. I also consider his condition a debilitating injury as it's not a sickness. It was from a physical action, hence, injury, and the results are debilitating. Also, JM said injury not injuries (Gawd, can I nitpick anymore?) and Bates had subdural hematoma, busted ribs, collarbone and concussion so he had injuries. Oh man, smack me a dead trout, quick! ;)
But yes, Bates was an excellent antagonist who, if there is a hearing, could provide some good drama/angst to the proceedings.
